Asylum in the United States

THE U.S. GOVERNMENT HAS MANY ASYLUM AND PROTECTION PROGRAMS FOR FOREIGNERS WHO ARE ALREADY IN THE UNITED STATES AND CAN PROVE THEY ARE VICTIMS OF POLITICAL, RELIGIOUS, RACIAL, SEXUAL, OR ANY OTHER FORM OF PERSECUTION THAT THREATENS THEIR PHYSICAL AND MORAL INTEGRITY AND PREVENTS THEM FROM RETURNING TO THEIR HOME COUNTRIES.

As this is a complex process and requires extensive documents, an Application for Asylum and Withholding of Removal requires a lot of technical knowledge, and it is essential to have the legal advice and assistance of an immigration office and an attorney who has proven experience in asylum cases for the United States.

Alexandre Law Firm’s legal team is led by Dr. Felipe Alexandre, a renowned Brazilian-American attorney who is considered a reference in immigration in the USA, and winner of several awards for his important contributions in this segment, especially in the areas of visas and green cards based on career, employment, or investment, and in asylum, refugee, and deportation processes from the United States. It is essential to know the background and trust the lawyer who will represent you to ensure the success of your immigration claim.

If you believe you are a victim of some kind of serious persecution and have been in the United States for some time or have even just arrived in the country, contact Alexandre Law Firm. We will be pleased to listen to you and assist you in your process if you are eligible for an asylum application.

Reasons for applying for asylum

Find out what are the main alleged reasons in cases of people who arrive in the United States claiming to be persecuted in their countries, and that can be considered an application for asylum and stay in America.

  • Persecution for racial discrimination;
  • Persecution for religious intolerance;
  • Persecution for homophobia or sex discrimination;
  • Political persecution for taking a stand against certain groups and rulers;
  • People fleeing regions of war or armed conflict;
  • Victims of sexual abuse or domestic violence.

How does an asylum process work in the United States?

The asylum seeker must be in U.S. territory to file a claim. People who consider themselves victims of some kind of persecution cannot start their asylum procedure in other countries.

After arriving in the USA, it is essential that the person in question files his or her asylum application within 12 months from the date of entry into the country, no matter his or her current status of residence in America, even if he or she is illegal.

In order to start an asylum process, the first step is to hire the services of an attorney or immigration office with experienced and qualified professionals to perform this type of service. The legal professional you choose will assist you in filling out and submitting the I-589 form (Application for Asylum and for Withholding of Removal) to the US immigration authorities.

Besides the I-589 form, the applicant must present concrete evidence that he or she is suffering from severe persecution and that he or she needs to stay in the United States since returning to his or her home country or former residence could result in a risk of death or imprisonment.

If your asylum case is initially accepted by the US authorities, your case will be sent to the EOIR Immigration Court, where it will be decided. Then, the final step will be to go to a court hearing where a decision on the asylum claim will be given. During the entire time of analysis and hearing, the asylum seeker is granted a temporary status that allows the person to stay in the U.S. with no possibility of removal or deportation to the home country. If a positive decision is made, then the asylum seeker is granted legal permanent resident status in America and can normally live and work in the country.

If you believe you are eligible for any of the categories that grant asylum in the United States, contact Alexandre Law Firm. We will be pleased to represent your asylum application to the US authorities.
